Those of us that remain in the RHC law suit against Ryan Homes now sit on the brink of conclusion.  The outcome will once again rest upon our fortitude and willingness to stand up for what is right.  Ryan Homes believes they can now starve us out; that they can force our hand and out last us.  I say, we have come this far, and it is time to finish.

 

If we are to win a meaningful financial victory, we have to again, let them know we are serious.  We have to be the ant at the picnic that they just need to make go away.  Our most effective weapon was the protest, especially now in a time when real estate is on the trough of its cycle.  To that end, we are planning a strategic approach to protesting that will include the following:

·        On-site protests at strategically selected sites

·        Leaving of “information flyers at model homes

·        Renewed effort to engage the media

 

Additionally, if any of you travel, we need to know the locations so that we may target model homes in other states for information leave behinds.  Imagine their faces when the manager at a Rochester or Detroit location calls corporate to inquire about the information leave behinds!!

 

During the latest negotiation, Ryan Homes has again discounted our resolve and insulted us with their offer.  As I talk to my neighbors, my anger grows at the stories of garage doors falling off tracks, windows leaking, air draft issues, concrete falling apart, gaps in walls and the other seemingly endless stories of poor craftsmanship.  I grow angry as I recall the promises of city services and other things that were “sold’ to us by this corporate giant.  I grow angry as I see the NVR stock trading at $480 on the backs of consumers like you and I while we struggle to get a fair settlement.

RESIDENTS CONTINUE TO BATTLE HOUSING GIANT

 

Resident’s of Ryan Homes Westfield Park development in Olmsted Falls are still battling Ryan Homes, the housing monolith, over the water and sewer assessment levied against the residents three years ago.

 

The resident’s in both the Ryan and Pulte Homes developments were assessed $4,400 assessments for the installation of water lines in Olmsted Township.  The residents claim that they were not properly informed of the assessment while Ryan Homes claims that a hidden clause in the contract allows them to not only escape liability from the assessment, but from any other costs residents may incur.  Pulte Homes on the other hand, accepted responsibility and paid the assessment for their home buyers.

 

The law suit was originally filed three years ago and has gone through several iterations during the legal process.  Ryan Homes has made at least two settlement offers which most residents found insulting.

 

According to one home owner, “Ryan Homes is doing what all big companies do when faced with wrong doing; hiding behind the slow legal process and hoping to starve the residents out so they may avoid responsibility.”  “We have seen many examples from across the country where this home builder has had quality issues, and they obviously don’t want to open Pandora’s Box.  Maybe they should just try building better homes and providing the truth right up front.”

 

The residents initially engaged in continued protests to express their dissatisfaction with the home builder.  The protests were stopped during negotiations to demonstrate good faith by the community,   However, the residents feel that the builder has not responded with the same good faith, and are now planning new protests, that may include more than just physical appearances, and may target locations outside the state of Ohio.

 

Whatever the outcome, these residents are committed to seeing this through.  “We can not allow this corporate giant, with stock trading over $480 per share, to continue to profit while those that have created the wealth continue to suffer.”  “Hopefully our legal system will not protect the big company, but will allow everyone their opportunity to have fair adjudication.”
